These Terms & Conditions (“Terms”) govern your access to and use of the Luxe Lifting Co. website and the purchase and use of products supplied by Luxe Lifting Co. (“we”, “our”, “us”).

By accessing our website, purchasing products, or using our products, you acknowledge that you have read, understood, and agreed to these Terms.

1. General Information

Luxe Lifting Co. supplies fitness and gym-related products, including but not limited to strength equipment, racks, barbells, benches, cable attachments, accessories, apparel, and training aids.

You must be at least 18 years old or have the consent of a parent or legal guardian to purchase products from our website.

2. Assumption of Risk

You acknowledge and agree that participation in strength training, resistance training, weightlifting, bodybuilding, powerlifting, fitness activities, and the use of gym equipment involves inherent risks, including but not limited to:

  • Serious bodily injury;

  • Muscle strains and tears;

  • Crushing injuries;

  • Equipment failure;

  • Paralysis;

  • Illness; and

  • Death.

By purchasing or using products supplied by Luxe Lifting Co., you voluntarily assume all risks associated with the use of such products and participation in fitness-related activities.

You acknowledge that improper installation, incorrect assembly, misuse, overloading, failure to inspect equipment, lack of maintenance, or failure to follow instructions may increase the risk of injury or damage.

You should seek appropriate medical advice before commencing any exercise or fitness program.

3. Spotter & Supervision Warning

Certain exercises and strength training activities may be dangerous if performed without proper supervision or safety precautions.

Luxe Lifting Co. strongly recommends that users:

  • Use a qualified spotter when performing heavy lifts or exercises involving barbells, squat racks, benches, cable systems, or similar equipment;

  • Utilise safety arms, catches, pins, restraints, or other protective mechanisms where available;

  • Never train beyond their physical capability or experience level;

  • Ensure all equipment is properly assembled, secured, and inspected prior to use;

  • Immediately stop using equipment that appears damaged, unstable, worn, or defective.

You acknowledge that failure to use proper spotting, supervision, or safety equipment may result in serious injury, paralysis, or death.

To the maximum extent permitted by law, Luxe Lifting Co. accepts no liability for injuries, damages, losses, or claims arising from:

  • Failure to use a spotter;

  • Inadequate supervision;

  • Unsafe lifting practices;

  • Failed lifts or dropped weights;

  • Misuse of racks, benches, barbells, attachments, cable systems, or safety mechanisms;

  • Use of equipment without appropriate training or experience.

All users are solely responsible for exercising safely and following accepted fitness industry safety practices.

4. Product Safety & User Responsibilities

You agree that you are solely responsible for the safe and proper use of all products purchased from Luxe Lifting Co.

You agree to:

  • Inspect all products before each use;

  • Immediately discontinue use of damaged or defective equipment;

  • Follow all instructions, warnings, and weight limits;

  • Properly assemble and maintain equipment;

  • Use appropriate flooring and safety precautions;

  • Ensure all users are physically capable of safely using the equipment;

  • Keep equipment out of reach of children unless specifically intended for children;

  • Use suitable spotters and supervision where necessary.

Commercial gym operators, trainers, and facility owners are solely responsible for maintaining safe environments and complying with all applicable workplace health and safety laws.

5. Release & Waiver of Liability

To the maximum extent permitted by law, Luxe Lifting Co., including its directors, officers, employees, contractors, suppliers, affiliates, and agents, shall not be liable for any injury, illness, death, damage, loss, or expense arising from:

  • Use or misuse of products;

  • Improper installation or assembly;

  • Failure to inspect or maintain equipment;

  • Failure to use proper spotting or supervision;

  • Overloading or exceeding recommended weight capacities;

  • Unauthorised modifications;

  • Unsafe lifting practices;

  • Failure to follow instructions or warnings;

  • Participation in strength training or fitness activities.

You release and discharge Luxe Lifting Co. from any and all claims, liabilities, demands, actions, or causes of action arising from or connected with the use of products supplied by us, except where liability cannot lawfully be excluded under Australian law.

6. Indemnity

You agree to indemnify, defend, and hold harmless Luxe Lifting Co., its directors, officers, employees, contractors, suppliers, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising out of or related to:

  • Your use or misuse of any product;

  • Injury to yourself or any third party;

  • Property damage caused by use of products;

  • Failure to follow instructions, warnings, or safety recommendations;

  • Failure to use proper spotting or supervision;

  • Negligent, reckless, or unlawful conduct;

  • Breach of these Terms;

  • Commercial or group use of products.

7. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law:

  • Our liability is limited to repair, replacement, or refund of the relevant product at our discretion;

  • We exclude liability for indirect, incidental, consequential, or special damages, including loss of profits, loss of business opportunity, personal injury, or property damage.

Where products or services are supplied for recreational purposes, you acknowledge that liability may be limited or excluded under relevant provisions of the Competition and Consumer Act 2010 (Cth) and applicable state legislation.

8. Product Specifications & Weight Ratings

All product specifications, dimensions, performance metrics, and weight capacities are estimates only unless expressly stated otherwise.

Users must not exceed recommended capacities or use products outside their intended purpose.

Luxe Lifting Co. accepts no liability for injuries, damage, or loss resulting from:

  • Overloading equipment;

  • Improper use;

  • Incorrect installation;

  • Lack of maintenance;

  • Unauthorised modifications.

9. Orders & Payment

We reserve the right to:

  • Refuse or cancel orders;

  • Correct pricing or listing errors;

  • Limit quantities purchased;

  • Suspend accounts suspected of misuse or fraud.

All prices are displayed in Australian Dollars (AUD).

10. Shipping & Delivery

Delivery timeframes are estimates only and are not guaranteed.

Risk in products passes to you upon delivery unless otherwise required by law.

You must inspect products upon delivery and notify us within [X] days of any transit damage or missing items.

11. Returns & Warranty

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes your statutory rights.

Warranty claims may be refused where products show evidence of:

  • Misuse or abuse;

  • Commercial overuse;

  • Failure to maintain equipment;

All content on this website, including logos, branding, graphics, text, product descriptions, videos, and images, is owned by Luxe Lifting Co. and may not be reproduced without prior written consent.

13. Privacy

Your use of this website is also governed by our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

15. Changes to Terms

We may amend these Terms at any time by publishing updated Terms on our website.

Continued use of the website or products after changes are published constitutes acceptance of the updated Terms.
